Terms of Service

Welcome to EasyBaby. By accessing or using the EasyBaby application ("App") and related services operated by EasyBaby AI ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. The App is designed for parents and caregivers to track information about their children.

2. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the App, its servers, or related systems.
• Interfere with or disrupt the integrity or performance of the App.
• Reverse-engineer, decompile, or disassemble any part of the App.
• Upload malicious content or use the App to harm others.
• Share your account credentials or caregiver invite codes with unauthorized individuals.

4. Subscriptions and Payments

EasyBaby offers premium features through subscription plans. Subscriptions are managed entirely through Apple's in-app purchase system ("Apple IAP").

• Billing: All payments are processed by Apple. We do not directly collect or store payment information.
• Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests must be directed to Apple in accordance with their refund policies.
• Price Changes: We may change subscription prices. Apple will notify you of price changes, and you can choose to accept or cancel before the new price takes effect.

5. AI-Powered Features

The App uses artificial intelligence to provide insights, summaries, and voice command processing. AI-generated content is for informational purposes only and should not be considered medical advice. Always consult a qualified healthcare professional for medical decisions regarding your child.

On supported devices (iOS 26+), certain AI features are processed entirely on your device using Apple Foundation Models. When on-device processing is used, your data does not leave your device for those features. Server-based AI features process only the minimum data necessary to provide the service.

6. Caregiver Sharing

You may invite other caregivers to access your baby's tracking data via invite codes. You are responsible for managing who has access. We are not liable for actions taken by caregivers you have authorized.

7. Intellectual Property

The App, including its design, code, features, content, and trademarks, is owned by EasyBaby AI and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. User Content

You retain ownership of the data you enter into the App (baby profiles, tracking events, notes, etc.). By using the App, you grant us a limited license to process, store, and transmit your content solely to provide and improve the service.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, EasyBaby AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless EasyBaby AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

12. Account Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users or to us. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction located in Ontario, Canada.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
